Building Dispute Practitioners Society Our report is prepared under VCAT Practice Note PNVCAT2 and measures the building work against the contract, plans and specifications, the National Construction Code, the Australian Standards that apply and whichever Guide to Standards and Tolerances governs the date of the contract.
19 checkpoints across 6 areas on a standard Aintree vcat expert witness report. If we cannot access a part on the day, it is written down as not inspected, not passed.
Examples from recent inspections around Aintree.

Building and Pest Inspections A single report for building and pest, covering the roof line and garden with the same detail as the walls.

Dilapidation Reports Document the condition of your property before the area is developed, with notes on any nearby excavation or construction.

Usually you must. VCAT will not take an application about a domestic building work dispute until the Building and Plumbing Commission's dispute resolution service (formerly DBDRV) has issued a certificate of conciliation saying the matter was unsuitable for conciliation or did not settle. The one exception is an application for an injunction. Before you go to the service, set out the defects for your builder in writing.
It helps at both stages. When every defect is listed with the requirement it misses and the repair needed, the builder and the conciliation officer have clear points to respond to. The service may also send its own assessor out to look at the work. Should the matter reach VCAT, its building disputes practice note says an available expert report on defective or incomplete work should be lodged with the application.
Neither, in the sense that matters. Under PNVCAT2 the expert's paramount duty is to VCAT rather than to whoever pays for the report, and the expert must not act as an advocate. That is why our report notes the work that passes as well as the work that fails.
The practice note lists the contents, including the expert's qualifications and experience, every instruction given, the facts and assumptions relied on, the documents looked at, a summary of the opinions, any matters outside the expert's field and a signed declaration. If rectification is recommended, the report has to explain why, state the likely cost and say whether a reasonable alternative is available. We support each item with photos, measurements and the clause it does not meet.
The starting point is the contract, plans and specifications. Section 8 of the Domestic Building Contracts Act 1995 implies warranties that the work matches them, complies with the law including the Building Act 1993 and is carried out with reasonable care and skill. After that come the National Construction Code and Australian Standards, for example AS 2870 for slabs, AS 3740 for wet areas and AS 1684 for timber framing, while finishes and tolerances are assessed using the Guide to Standards and Tolerances.
That turns on when the contract was made. The 2026 Guide covers contracts signed or work begun on or after 1 August 2026, so a house built under an earlier contract is judged against the 2015 Guide. The Guide is advisory only, and the contract, the law, the NCC or a standard prevails wherever it says something different.
There is a limit. Section 134 of the Building Act 1993 stops a building action being brought more than 10 years after the occupancy permit issued, or after the certificate of final inspection where no occupancy permit was issued. Because the section 8 warranties carry over to later owners, someone who bought an Aintree home from the first owner, including in Woodlea Estate, can rely on them inside that period.
We will if VCAT orders it. The tribunal can direct experts to meet in a conclave, work in good faith to narrow the points in dispute and lodge a joint report showing what they agree on, what they do not and their reasons, a document also known as a Scott Schedule. In more complex hearings the report is generally taken as read, and VCAT may hear the experts together in a panel.
It is due by whatever date VCAT sets in its orders. Where no date has been set, PNVCAT2 says it must be filed and served no less than 10 business days ahead of the mediation, compulsory conference or hearing at which it will be used. The tribunal can refuse a report that arrives late, so please tell us your dates at the time of booking.
An experienced building inspector carries out the inspection, works through the documents and signs the declaration that the practice note calls for. As VCAT requires, the report sets out the inspector's qualifications and discloses any relationship with you.
We do, throughout the City of Melton and close by, including Bonnie Brook, Deanside, Grangefields, Rockbank and Truganina. The fee is based on how many items are in dispute, the size of the house and how many documents need reviewing. We give you a quote after we have read the contract and your list of defects.
